INCREASE OF MILITARY PENSION BY 2 TIMES

Volodymyr Dmytrovych turned to "Prikhodko&Partners" Law Office for help in recalculating his military pension. The pensioner was dismissed from service as the head of the Department of the Foreign Intelligence Service of Ukraine.

Until 2018, the Claimant was awarded a pension based on the following components of financial security for pension calculation:

• official salary;
• salary for a military rank;
• seniority allowances;
• additional types of financial support.

In 2018, the head office of the Pension Fund of Ukraine in Kyiv recalculated the client's pension on the basis of the Certificate on the amount of monetary support for the recalculation of pensions as of 03/01/2018, in accordance with the Resolution of the CMU of 02/21/2018 № 103 "On the recalculation of pensions to persons who have been dismissed from military service, and some other categories of persons" and did not take into account additional types of financial support when calculating the pension.

Volodymyr Dmytrovych appealed to the Foreign Intelligence Service of Ukraine with a request to prepare and submit to the Main Department of the PFU in Kyiv a certificate on the amount of financial support dated 03/05/2019 with an indication of monthly additional types of financial support.

The Financial and Economic Department of the Foreign Intelligence Service of Ukraine provided a response dated September 1, 2020 No. 17/1/1900, which prepared a certificate on the amount of financial support as of March 5, 2019 dated August 31, 2020 No. 79 for a similar position (on the day of dismissal) held by a pensioner, indicating the monthly additional types of financial support.

However, the Main Directorate of the Pension Fund of Ukraine in Kyiv refused to recalculate the pension on the basis of the issued certificate on the amount of financial support, taking into account additional types of financial support.

On September 3, 2021, the District Administrative Court of the city of Kyiv in case No. 640/10291/21 made a decision to satisfy the claim of V.D., by which it decided:

To oblige the Main Department of the Pension Fund of Ukraine in Kyiv to transfer and pay V.D. a pension on the basis of a certificate on the amount of financial support as of 03.05.2019, including the following components of financial support: official salary UAH 9,400, salary according to military rank - UAH 1,480, allowance for years of service (50%) - UAH 5,440, allowance for special features of service (44%) - UAH 7,180.80, allowance for service under regime restrictions (15%) - 1,410 , premium (30%) - UAH 2,820.00, which were taken into account before calculating the pension, starting from 04.01.2019, taking into account previously paid payments.

On the basis of this court decision, the Main Department of the PFU in Kyiv recalculated the pension of Volodymyr Dmytrovych from February 1, 2022. As of February 1, 2022, our client's pension is UAH 19,411.
