INCREASE IN CLIENT’S MILITARY PENSION FROM 70% TO 79% OF CASH SECURITY

Oleksandr Vyacheslavovych asked Prykhodko&Partners for help in recalculating his military pension. The pensioner was dismissed from the Ministry of Internal Affairs. On December 29, 2007, Oleksandr Vyacheslavovych was granted and calculated a pension for years of service, amounting to 28 years, in the amount of 79% of the relevant cash benefits at the time of dismissal in accordance with the Law of Ukraine of 09.04.1992 №2262-XII "On pensions of persons discharged from military service, and some other persons."

The Main Department of the Pension Fund of Ukraine in Kyiv in 2018 recalculated the client's pension from 01.01.2016.

PFU in Kyiv when recalculating the pension in 2018 on the basis of paragraph 3 of the Resolution of the Cabinet of Ministers №103 reduced the basic pension of a pensioner from 79% to 70% of the amount of cash benefits. Based on this, Oleksandr Vyacheslavovych appealed to the District Administrative Court of Kyiv with the following claims:

To oblige the Main Department of the Pension Fund of Ukraine in Kyiv to transfer and pay Oleksandr Vyacheslavovych a pension in the amount of 79% of cash benefits in accordance with Article 63 of the Law of Ukraine "On Pensions of Discharged Persons and Certain Other Persons" of April 9, 1992 № 2262-ХІІ, Resolution of the Cabinet of Ministers of Ukraine of November 11, 2015 № 988 “On financial support of police officers of the National Police” and Resolution of the Cabinet of Ministers of Ukraine of 21.02.2018 № 103 “On recalculation of pensions for persons discharged from military service and some others categories of persons ", without restrictions on the maximum amount, starting from 01.01.2016, taking into account previous payments, making a payment immediately and in the same amount.

By the decision of the District Administrative Court of Kyiv of January 16, 2022, it was decided to oblige the Main Department of the Pension Fund of Ukraine in Kyiv to transfer and pay Oleksandr Vyacheslavovych a pension in the amount of 79% of the cash security.
