IMPORTANT ASPECTS TO WHICH YOU NEED TO PAY ATTENTION TO WHEN REGISTRATION OF EXIT FOR PERMANENT RESIDENCE ABROAD FOR CITIZENS OF UKRAINE
When a person resides in another state, has a temporary or permanent residence permit in the country of his stay, and has the opportunity to obtain citizenship, or, in relation to some countries, to obtain a permanent residence permit with the subsequent acquisition of citizenship, a permit must be issued in the territory of Ukraine for permanent residence abroad.
The need for such registration may arise both immediately after moving from Ukraine to a certain country, and after tens of years, when people have lived in other countries for years and do not receive documents there confirming the fact of citizenship or permanent residence.
The process of obtaining such permission often creates difficulties, since each person has an individual, special situation.
What should you look out for first?
- Personal paperwork
When applying for a permit to travel abroad for permanent residence, you must be present in person. The collection of documents necessary for such a permit can be entrusted to a representative by a notarized power of attorney or to your legal representative, but when the documents are submitted and when the final stamp is put into the foreign passport of Ukraine about leaving for permanent residence in a certain country, only personal presence.
- Absence of registered and operating LLC or PE with the participation of the applicant
According to the legislation, an integral document when going through the procedure for issuing a permit to leave for permanent residence abroad is a certificate from the tax office about the absence of arrears in the payment of taxes and fees. The tax office will not issue such a certificate to the applicant if the person does not pass a desk audit or if he has an open LLC or state of emergency.
- For men applying for a permit to leave for permanent residence abroad, the issue of resolving relations with the military registration and enlistment office remains very important
According to the law, it is necessary to deregister from the military registration and enlistment office in which the person is registered (this is the military registration and enlistment office at the place of registration of the place of residence in Kiev) and receive a document confirming this fact.
If the person applying for a permanent residence permit has minors or young children, it is imperative to obtain the notarized consent of the second parent to leave the child for permanent residence abroad. Or, provide a court decision on deprivation of parental rights, a death certificate or other document.
- Consent of a minor child
A child from 14 to 16 years old must also give his notarized consent to travel abroad for permanent residence.
- Request from the State Migration Service to the Security Service of Ukraine
When issuing a permit to leave for permanent residence abroad, the migration service without fail makes a request to the Security Service of Ukraine to confirm the presence or absence of grounds for obtaining a permit to leave for permanent residence abroad, for example, unpaid alimony, debts to the state, the presence of open criminal cases , and others.
- You need to carefully consider your documents
If there are differences or discrepancies in at least one number / letter between the two original documents required for obtaining permission, there will be a need to make changes to the document, to reissue or exchange it. You need to clearly understand for yourself that such actions will take a decent amount of time.
