Article 263 of the CCU covers the following main offenses:
- Illegal carrying, storage, acquisition, transfer or sale of weapons, ammunition, explosives or explosive devices.
- Manufacturing weapons or explosive devices without an appropriate permit.
- Transportation or shipment of weapons or ammunition in violation of established rules.
A key element for criminal liability is the lack of an official permit for handling weapons, ammunition or explosives.
The subject of a crime under Article 263 of the Criminal Code of Ukraine may be any natural person of sound mind who has reached the age of 16. At the same time, if weapons or ammunition fall into the hands of military personnel or officials who abuse their position, their actions may be qualified under other articles of the Criminal Code of Ukraine, which provide for aggravating circumstances.

Regarding liability under Article 263 of the Criminal Code of Ukraine, according to Article 263 of the Criminal Code of Ukraine, the following types of punishment are provided for illegal handling of weapons:
- Under Part 1: imprisonment for a term of three to seven years (Article 263).
- Under Part 2: the same act, committed repeatedly or by prior conspiracy by a group of persons, is punishable by imprisonment for a term of five to ten years (Article 263-1).
- Under Part 3: imprisonment for a term of eight to twelve years (Article 263-1).
Mitigating circumstances are:
- Voluntary surrender of weapons. If a person voluntarily informs law enforcement agencies about the presence of illegal weapons in his possession and hands them over, he may be exempted from criminal liability (Part 3 of Article 263 of the Criminal Code of Ukraine).
- Cooperation with the investigation. Providing information that helps identify sources of illegal arms trafficking may reduce the sentence.
- Committing a crime through coercion or threat. If a person proves that they were forced to keep or transport a weapon under duress, this may also be taken into account by the court.
But the aggravating circumstances are:
- Recidivism. Repeated commission of the act significantly increases the punishment.
- Weapons or explosives were used to commit a serious crime (for example, a terrorist act, murder or robbery).
- Participation in a criminal group. Conspiracy or cooperation of several people for the illegal trafficking of weapons is considered an aggravating circumstance.
After detecting a violation, the investigative authorities initiate criminal proceedings. The main stages include:
- Isolation and seizure of evidence: weapons, ammunition or explosives.
- Appointment of an expert examination to establish the technical characteristics of the seized items, their combat suitability.
- Establishing the origin of the weapon: whether it was stolen, illegally acquired or manufactured independently.
During the investigation, witness statements, surveillance camera recordings, data from mobile phones and other investigative actions play an important role.
For offenders, in addition to imprisonment, the court may impose additional sanctions, such as:

- Strengthening control over the legal circulation of weapons. Registration of weapons, regular inspections of their storage conditions, establishing strict requirements for obtaining permits.
- Information and educational work. Raising awareness among citizens about the rules for handling weapons and responsibility for their violation.
- Combating corruption in the field of control over the circulation of weapons.
