What is suspicion in criminal proceedings?

Let's start with the fact that the person who received the suspicion is not considered a criminal.

Suspicion can be characterized as an investigator's assumption that a person may be involved in the commission of certain criminal acts. A person's guilt is established only by a court. That is, a person is not considered a criminal during the entire pre-trial investigation. This is guaranteed by Article 62 of the Constitution of Ukraine and decisions of the European Court of Human Rights. However, quite often the above-mentioned legal basis is ignored.

In what situations is a person informed of suspicion?

In accordance with Article 276 of the Criminal Procedure Code of Ukraine, a person receives a notification of suspicion in the following cases:

• The person was detained at the scene of the crime after committing a criminal offense

At the moment of detention, a person immediately receives the procedural status of a suspect. A suspect is a person who has been detained on suspicion of committing a crime.

• Selection of preventive measures for the person

According to the current Ukrainian legislation, the preventive measure is applied only to the suspect.

Among the most common preventive measures: personal guarantee, bond, personal commitment, detention, house arrest, detention.

• The fact that the investigator or prosecutor has sufficient evidence to suspect the person

In this case, the person receives a notification of suspicion after a sufficient amount of evidence, in the opinion of the investigator, has been collected.

Regardless of the situation in which a person was served with a notice of suspicion, the help of professional lawyers cannot be dispensed with.

Important: the notice of suspicion must be delivered to the person personally, on the day it is drawn up. If the person's place of residence has not been established, the notice may be served on an adult member of his family who lives with him.
