What should be understood by a tender offer?

If you refer to the Law of Ukraine "On Public Procurement", you can find the following definition of a tender offer - an offer regarding the subject of procurement or its part (lot), which a participant in the procurement procedure submits to the customer in accordance with the requirements of the tender documentation. Therefore, thanks to the tender offer, the public procurement participant discloses to the tender customer the terms of future cooperation with him.

What does a tender offer consist of?

Conditionally, the tender offer can be divided into two parts:

  • electronic form - in which the price offer for the provision of services, goods, performance of works, etc. and payment terms must be indicated;
  • copies of documents that serve as confirmation that the public procurement participant meets the established criteria of the tender documentation and other requirements in accordance with the legislation of Ukraine.

Importantly! The most important thing in the tender offer is the proposed price offer, because it was precisely to save budget funds that public procurement was created from the very beginning. In addition, it should be taken into account that if the price is too high, it can automatically lead to the loss of the participant in the tender, and if it is too low, then the customer can also reject the offer as not corresponding to the market value.

What is the deadline for submitting a tender offer?

It can be seen from Resolution No. 1178 that the deadline for submitting tenders cannot be less than seven days from the date of publication of the announcement of open tenders in the Prozoro system. Therefore, after the expiration of this period, the Prozoro system will not accept your bids.

In addition, it is worth noting that your tender offers will remain valid for the period specified in the customer's tender documents. If necessary, the customer can extend this term.
