How can you get a driver's license if a person is prosecuted under Art. 130 Code of Ukraine on Administrative Offenses

Citizens who were deprived of the right to drive cars under Art. 130 of the Code of Ukraine on Administrative Offenses, the driver's license is returned only when they pass the mandatory extra-ordinary medical examination and re-take the theoretical and practical exams at the regional service centers of the Ministry of Internal Affairs.

If a person has several open categories in the driver's license, then the exams must be taken according to the highest category.

What documents must be submitted to return rights under Art. 130 Code of Ukraine on Administrative Offenses?

A typical list of documents that allows a person to retake practical and theoretical exams for obtaining a driver's license is:

  • a copy of the document certifying the citizen (for example, a passport, ID card, foreign passport, temporary certificate of a citizen of Ukraine, a certificate of permanent or temporary residence, a certificate confirming the status of a refugee, etc.);
  • a copy of the RNOCPP (if it is not available in the database of regional service centers of the Ministry of Internal Affairs);
  • a receipt for payment of services for taking exams;
  • a medical certificate confirming the citizen's physical and psychological ability to drive vehicles (mandatory in the case of arrest of a person under Article 130 of the Code of Ukraine on Administrative Offenses).

After receiving the appropriate package of documents, employees of regional service centers of the Ministry of Internal Affairs will be able to admit a person to take practical and theoretical exams.

What is the algorithm for returning a driver's license for those who received it for 2 years?

As a general rule, if a citizen is deprived of the right to drive cars under Art. 130 of the Code of Ukraine on Administrative Offenses, who received it for the first time in 2 years, the driver's license is not returned in the standard format.

To renew the opportunity to drive vehicles, a citizen must first undergo retraining at an educational institution (driving school) to obtain relevant knowledge and then apply to the regional service centers of the Ministry of Internal Affairs to pass practical and theoretical exams.

After a citizen successfully passes all exams at the center of the Ministry of Internal Affairs, he will be able to obtain a driver's license again for 2 years. And only later, when this term expires and the person does not commit any more administrative or criminal offenses, he will be able to obtain rights for 30 years.

Importantly! During martial law in the country and after 3 months from the moment of its termination or cancellation, rights are returned by authorized employees of any service centers of the Ministry of Internal Affairs, regardless of the place of actual storage of the confiscated driver's license of a citizen.
