How to pass the MSEK: step-by-step instructions for obtaining a disability group

Obtaining a disability group in Ukraine is associated with passing a medical and social expert commission (MSEK). This procedure can seem complicated and intimidating, but knowing the steps and being prepared makes the process much easier. Especially if you turn to legal experts for quality support.

Referral to a doctor

The first step is a visit to the family or treating doctor. He will conduct an examination, study the medical history and refer you to the MSEK, if he recognizes the grounds for establishing disability. It is important to get all the necessary medical documents confirming your condition from the doctor: extracts from the outpatient card, results of examinations, tests, etc.

Collection of documents

To pass the examination, you will need the following documents:

  • Passport or ID card.
  • Identification code.
  • Referral to MSEK from a doctor (form 088/o).
  • Medical documents confirming your condition.
  • Photo 3x4.
  • Additional documents that may be required (for example, a certificate of the unemployment group, a war veteran's certificate, etc.).

Submission of documents

Collect all the necessary documents and contact the MSEK at your place of residence. Addresses and contact information can be found on the website of the Ministry of Health of Ukraine or at your local polyclinic. Usually, documents are submitted in person, but in some cases it is possible to submit online or through an authorized person.

Passing MSEK

On the day of the scheduled examination, you will submit your documents and undergo an examination by MSEK doctors. The commission can appoint additional examinations, if necessary. After the examination, the MSEK will make a decision to grant you a disability group or to refuse it.

The commission can establish one of three groups of disability: I, II or III. Each group of disabilities gives the right to certain social benefits and assistance. After making a decision, the MSEK will issue you with a relevant document: an act that confirms your disability group and entitles you to social benefits.

Importantly:

  • Passing MSEK is a free procedure.
  • You have the right to legal assistance during the commission.

If you do not agree with the commission's decision, you can appeal it. This can be done in two ways:

  1. Pre-trial appeal:
  • Within one month of receiving the decision, you can apply for a review to the same commission that made the decision.
  • In the application, you must indicate the reasons for which you do not agree with the decision and add evidence to support them.
  • MSEK will consider your application and within 10 days will make a decision on its satisfaction or rejection.
  1. Court appeal
  • If you do not agree with the MSEK's decision on review, or if the MSEK did not consider your application within 10 days, you can appeal it in court.
  • You have 6 months from the moment you became aware of a violation of your rights to file a lawsuit.
  • In court, you will need the help of a lawyer who specializes in medical law.
