HOW TO OBTAIN THE ACT OF INSTALLATION OF THE FACT OF CARE
Crossing the border in war is different from what we are used to in peacetime. However, if a person in the category of persons liable for military service takes care of a relative or other person with a disability of group I or II, the law provides for the possibility of traveling abroad to meet the needs of such persons. To do this, you need to draw up an appropriate document, because without documentary evidence that you yourself are caring for such a person, accompanying him outside of Ukraine will be impossible.
When can check-out be available
This document can be obtained by those persons who:
- have one of the parents from among persons with disabilities of group I or II and accompany such a person to travel outside Ukraine (here it is important to have a document confirming family ties);
- have such a person among the parents of the wife or husband and accompany abroad;
- care for such a person, even if they are not related, and can confirm this with documents certifying the receipt of assistance for care and documents certifying the disability of the said person.
In addition to the aforementioned documents, in each of these cases, an Act of Establishing the Fact of Care is still pending.
How and where to get such an Act
The basis for obtaining the Act may be the appeal of both the person with a disability himself and the carer to the authorized bodies. In this case, such body is:
- district or district state administration in Kyiv;
- executive body of a village, settlement or city council.
If a person with a disability in need of care is internally displaced, then the application for care is submitted at the place where his actual residence is registered.
What is the time frame for issuing the Act of Establishing the Fact of Supervision?
For the issuance of this Act, a period of up to 5 working days is given from the moment the application was submitted. The form of the Act is arbitrary. It can be either issued personally to the applicant or sent by mail. Thus, the legislative norm provides for everything necessary to ensure that the document can be obtained within a reasonable time and nothing prevents traveling abroad when necessary.
