What are the grounds for obtaining German citizenship?

If you are interested in the mechanism of obtaining German citizenship, it is possible on the following grounds:

  1. if you have German roots;
  2. If your relatives are late immigrants from Germany;
  3. If you are a permanent resident of Germany;
  4. if you are married to a German citizen.

The most common of these grounds is the first one.

How to obtain German citizenship if you have German roots?

There are different options depending on the circumstances of a particular family history. For example, it is much easier to do this on the maternal side. In order to get comprehensive answers and an algorithm of actions in your situation, you should use the advisory support of the team of Prikhodko & Partners Law Firm. During the consultation, we will analyze your request and prospects for obtaining German citizenship on the basis of descent.

If we talk about general recommendations that are relevant for everyone who has German roots and wants to obtain citizenship of this country, they are as follows

  • collect documents proving German ancestry;
  • submit them to the German consulate (this can be done both in the state of your citizenship and in the state of legal residence)
  • obtain the necessary documents from the consulate;
  • arrive in Germany and complete the citizenship procedure there.

This is the sequence of actions if you are going to apply for German citizenship by descent.

Is German citizenship available for refugees?

On June 27, a new law comes into force in Germany, according to which Ukrainian refugees who have completed the documents under paragraph 24 will be able to obtain German citizenship. Briefly, this opportunity means obtaining citizenship by naturalization after 5 years of residence in Germany.

Another piece of positive news is that it is possible to obtain citizenship even in 3 years if certain conditions are met. They are as follows:

  • learn German to B1 level and pass an exam;
  • pass a test on the social and legal system of Germany;
  • be a law-abiding person and not have a criminal record for a serious crime;
  • recognize Germany's responsibility for the Holocaust, including the protection of Jewish life.

Another piece of positive news is that as of June 27, 2024, a legal provision will come into force that does not require renunciation of existing citizenship in order to acquire German citizenship. Thus, Germany will now recognize dual citizenship.
