In such situations, it becomes necessary to legally resolve the person's status: declare them missing or dead. This procedure has a clearly defined procedure and requires appropriate legal support.

Who is considered missing in action under special circumstances?

A person is considered missing under special circumstances if his/her disappearance is related to an armed conflict, military action, temporary occupation of the territory of Ukraine, or emergency situations of a natural or man-made nature.

The key is the causal connection between the dangerous events and the individual's absence. For example, if a person was in an active combat zone, came under fire, or was left in occupied territory without communication, this may be grounds for further legal action.

 

Regulatory framework

The procedure for declaring an individual deceased is regulated by the provisions of the Civil code of Ukraine and the Civil procedure code of Ukraine.

According to Article 46 of the Civil code of Ukraine, an individual is declared dead on the day a court decision enters into legal force. If the individual disappeared under circumstances that directly threatened their life (armed conflict, military action, or disaster), the court may determine the day of their presumed death as the date of death.

This is especially important for military personnel, as the correct determination of the date of death affects inheritance rights and social payments.

The procedure for filing a claim in court

The application is submitted to the local general court at the last known place of residence of the missing person or the applicant.

The application must indicate:

  • the purpose of the applicant's request to have the person declared missing or dead (to process an inheritance, receive social assistance, or terminate obligations);

  • facts indicating a danger to life;
  • evidence supporting the above.

If we are talking about a military service member, it is necessary to include documents from the military unit, extracts from orders, certificates of participation in military operations, and a missing persons report.

The following documents must be attached to the application:

  1. an explanation regarding the inability to obtain a death certificate;
  2. a written refusal by the state civil registration authorities to register the death without a court order;
  3. eyewitness testimony;
  4. official documents;
  5. medical or other materials confirming the circumstances of the disappearance.

The court evaluates the totality of the evidence. Even in the absence of a body or an official medical report, a positive decision can be obtained if the circumstances convincingly indicate death.

Based on the review, the court decides whether to declare the person dead or deny the application. The decision becomes final after the appeal deadline has expired.

  • termination of his civil rights and obligations;
  • opening of an inheritance;

  • arrangement of social guarantees and a one-time financial assistance to the family of the deceased service member.

If the person appears or his location is established, the court decision may be cancelled.
