How to legalize a house on a country plot (garden society) in Ukraine?

According to the current legislation, any real estate object that was built on one or another plot of land must be legalized, that is, the necessary package of documents must be issued. In their absence, the building will fall under the "self-built" category. In this article, we will consider how to legalize a house on a country plot (garden society) in Ukraine. Why legalize the house?

Let's start with the fact that the legalization of a house on a country plot involves obtaining the appropriate package of documents. However, as for the legalization process as a whole, it begins even before construction. Thus, there are 2 ways: registration through the existing ownership right to the land plot, supplemented by obtaining a construction permit and legalization of the already built real estate object, i.e. self-construction. The second way of registration is relevant for an already built house, however, in the absence of documents. If you do not go through any of the specified procedures, the building will be considered nothing more than self-construction.

Legalization procedure: what should be considered?

Ukrainian legislation provides for a single form of registration of residential, country and garden buildings. However, there are still certain differences in the legalization procedure of various real estate objects.

Let's consider this issue in more detail.

• Buildings that were erected before 05.08.1992

The mentioned real estate objects do not include the commissioning procedure. Ownership registration is immediately applied to them. Such objects are issued after the development of a technical passport and registration of the right of ownership. The owner of such a house receives an extract from the real estate register.

• Houses built before April 9, 2015 (area - up to 300 m²).

A simplified registration procedure is used for this category of buildings. Legalization is carried out according to the principles of construction amnesty. It is enough to develop a technical passport, where there will be a note about conducting a technical report and a technical inspection.

Registration of the Declaration on the readiness to put the real estate object into operation is taking place. As a result, the real estate owner receives a Registration Statement.

• Houses built after 04/09/2015 with an area of up to 500 m².

Such houses are legalized according to the general procedure.

• Houses built after 04/09/2015 with an area of more than 500 m².

Such houses require a radically different approach to the process of legalization of the real estate object.

• Documents confirming ownership of the house and land plot.
• Sketch or construction project (if available).
