What does the law say about the possibility of increasing pensions?

Part 4 of Article 42 of the Law of Ukraine «On Compulsory State Pension Insurance» specifies the grounds that give the right to increase a pension. They should be distinguished depending on whether the pensioner is working. If they continue to work, the basis for the pension increase is an increase in length of service or salary.

If the pensioner is no longer working, the recalculation is carried out automatically when the subsistence minimum is increased. It is important to note that for pensioners who do not work, the recalculation is carried out from the day when the new subsistence minimum was established.

As for the date of recalculation for pensioners who continue to work, it is carried out from the date of dismissal or termination of employment.

What requirements must an application for recalculation meet?

The requirements for pension recalculation applications are set out in the Procedure for Submitting and Processing Documents for the Appointment (Recalculation) of Pensions in Accordance with the Law of Ukraine «On Compulsory State Pension Insurance». This document was approved by the Pension Fund Resolution No. 22-1 dated November 25, 2005. In particular, it is worth paying attention to Annex 1 to the said Procedure.

When the application is submitted in an arbitrary form, it is necessary to clearly state the pensioner's intention to recalculate the pension, as well as the relevant grounds. It is possible that Pension Fund representatives will refuse to recalculate the pension, citing formal reasons. For example, they may state as a reason for refusal that the application was not executed in accordance with the requirements of the Procedure.
