HOW TO GET A POSTPONEMENT OF MOBILIZATION?

There has been a war in Ukraine for more than a year, and with it general mobilization. This means that men aged 18 to 60 can be called up for military service on mobilization. But there is a certain category of persons to whom the law has granted the right to receive a deferment from mobilization.

What is the postponement of mobilization?

The right to a postponement of mobilization has the persons specified in Art. 23 of the Law of Ukraine "On Mobilization Training and Mobilization".

This article provides a list of persons who can receive a postponement, including parents with many children, temporarily unfit for health reasons, booked by enterprises, institutions and organizations, and others.

Algorithm for obtaining a postponement

• Analyze under which category of exemption from mobilization a person falls.
• Depending on the situation, prepare a package of documents that will confirm the person's right to receive a deferment from mobilization. For example, if a man has three or more children to support, he must provide copies of the children's birth certificates, where he is listed as the father, when applying to the TCC and SP. It is also worth noting that such copies must be duly certified.
• Individuals should write an application to the TCC and the joint venture to grant a deferment from mobilization, indicating the basis for providing supporting documents.
• The TCC and the JV are obliged to consider such an application and, if there are grounds, grant a postponement of mobilization.
• Information on granting deferment from mobilization must be entered in the military registration document.

Importantly! It is possible to receive a postponement of mobilization only if the conscript has not yet acquired the status of a military serviceman. In other words, if a person is enrolled in a military unit, it is no longer possible to exercise the right to deferment from mobilization, because the person is actually already mobilized.

How long can a deferment from mobilization be granted?

There is no specific time for the duration of the postponement from mobilization, since everything depends on the reasons for obtaining such a postponement. That is, until the circumstance that gives the right to postponement passes. For example, if a person is studying full-time until January 1, 2024, then the deferral of mobilization will apply until that time.

If the TCC and SP do not accept an application for deferment from mobilization?

In this case, you can send an application with properly supporting documents to the TCC and SP by registered mail with a description of the attachment.
