HOW TO GET A DELAY FROM MOBILIZATION?

The issue of receiving a deferment from conscription for military service during mobilization is regulated by the provisions of Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization". In general, the specified article consists of five parts, the first, third and fifth of which contain a comprehensive list of conscripts who have the right to receive a deferment from conscription for military service from the time of mobilization.

Conditionally, it is possible to distinguish the following grounds for conscripts, which give the right to receive a postponement of conscription for military service during mobilization:

  • reservation of conscripts for the period of mobilization and for wartime by state authorities, other state bodies, local self-government bodies, as well as by enterprises, institutions and organizations in accordance with the procedure established by the Cabinet of Ministers of Ukraine;
  • according to the state of health of the conscript (persons with disabilities, recognized by the military medical commission as temporarily unfit for military service due to their state of health for a period of up to six months);
  • by family circumstances (in particular, maintenance of three or more children under the age of 18, independent upbringing of a child (children) under the age of 18, the presence of a wife (husband) from among persons with disabilities and/or one of their parents or the parents of the wife (husband ) from among persons with disabilities of group I or II, etc.);
  • having the appropriate status of conscript (in particular, people's deputies and employees of law enforcement agencies, students, assistant trainees, graduate students, doctoral students, scientific and scientific-pedagogical workers, etc.);
  • the presence of close relatives from the number of persons who died or went missing during an anti-terrorist operation, during the implementation of measures to ensure national security and defense, repelling and deterring armed aggression of the Russian Federation in the Donetsk and Luhansk regions, as well as during the provision of national security and defense, repulsion and deterrence of armed aggression against Ukraine during martial law).

If you have any of the reasons listed in Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization", you must apply to the territorial recruitment and social support center where you are registered for military service with a corresponding application. Such an application must be accompanied by documents that confirm the existence of a suitable reason for receiving a deferment from conscription for military service during mobilization.

So, in particular, if you have a disability group, you must provide a certificate of inspection by a medical and social expert commission and, if available, an ID card with a disability. If you are the father of three or more children - birth certificates, marriage registration certificate, etc.

 

Also, we emphasize that delay in obtaining a deferment, if there are grounds for it, may lead to a situation where you are mobilized, and the grounds for which you could have received a deferment earlier are not in the list of grounds for dismissal from military service.
