In recent years, the issue of mobilization and service in the ranks of the Armed Forces of Ukraine has become particularly relevant due to the long war with Russia. Territorial recruitment and social support centers (TCC and SP), which are the successors of military commissariats, play a key role in organizing the mobilization and conscription of citizens for military service. In this regard, many citizens of Ukraine are interested in whether they may be wanted by these authorities, as well as how to find out.

What are TCC and SP?

TCC and SP are state bodies that are responsible for organizing conscription for military service, mobilization, keeping military records and social support of military personnel. In particular, they carry out recruitment for both fixed-term military service and contract service, as well as involve them in serving during mobilization.

If a citizen of Ukraine does not appear when summoned by the TCC to undergo a medical examination, to clarify data or to be drafted, he may be included in the list of persons evading military duty. In this case, the military authorities have the right to declare him wanted.

Grounds for searching for the person of TCC and JV

In order to understand whether a person is wanted, you should know the main reasons for a wanted ad:

  1. Failure to appear on summons to the TCC. If a person who has received a summons or other official summons from the TCC does not appear for the medical commission or for clarification of data, he can be recognized as evading military service. For more details about non-appearance at the TCC and SP after serving a summons or non-appearance on a "combat summons", read the articles - "Non-appearance at the Military Committee after serving a summons" and "Subpoena for dispatch or combat summons: non-appearance and consequences"
  2. Avoidance of mobilization. Citizens who received a summons for mobilization and did not appear within the specified time may be included in the list of persons evading mobilization.
  3. Change of residence without notification to the TCC. If a person changes their place of residence without notifying the relevant authority, they can also be put on the wanted list.
  4. Court decisions. In some cases, a person can be officially declared wanted after a court decision on prosecution for evasion of service.

How to find out if a person is wanted by military commissariat

How to check whether a person is wanted by TCC and SP?

You can check whether a person is wanted in several ways:

  • Personal visit to TCC and JV

The most obvious way to find out about your status is a personal visit to the local TCC and JV. A conscript can contact the appropriate authority and clarify whether there are summonses in his name, whether he is on the list of those who are wanted for failure to appear or evasion.

However, this method has several disadvantages:

  1. A person who evades may be immediately detained or forced to explain the reasons for not appearing.
  2. For some citizens, the very visit to the TCC and SP can cause fear or apprehension due to possible prosecution.
  • Appeal to law enforcement agencies

In cases where there is suspicion that a person may be wanted, you can contact the National Police of Ukraine. Upon request, the police can check whether there is relevant information in the database of wanted persons.

To make such a request, you need to go to the nearest police station with your passport or other identification document.

  • Checking search databases

Data on wanted persons may be posted on the official websites of state bodies of Ukraine. For example, the Ministry of Internal Affairs of Ukraine has a special section where you can find information about wanted persons. This also applies to those who evade military duty.

To use this method, it is enough to have access to the Internet and enter relevant data, such as the name, surname and year of birth of the person.

  • Request through a lawyer

Attorneys who specialize in military law can help citizens find out if they are wanted. They have the opportunity to contact official sources and receive information about the client's status. This may be the safest way for those who are afraid of the possible consequences of personally contacting the TCC or the police.

  • Appeal to judicial authorities

If a citizen has already been sentenced to prosecution for evasion of military service, information about this can be obtained through the Unified Register of Court Decisions. This online resource allows you to find solutions for a specific person by his name or other data.

What to do if a person is wanted

If it becomes known that a person is wanted, it is necessary to immediately contact a lawyer. It will help:

  1. assess possible legal consequences;
  2. prepare documents to protect the client's interests;
  3. to represent the interests of a person in court or during the consideration of a case in the TCC.

It is also important to act in accordance with the law, since evasion of military service in conditions of war or mobilization may entail not only administrative, but also criminal liability.

Legal consequences of evading military service

According to Ukrainian legislation, evasion of military service can have serious legal consequences. In particular, the following types of punishments are provided for:

  • Fine. This is one of the mildest types of punishment that can be imposed for the first violation provided for in Articles 210 and 210-1 of the KUpAP.
  • Imprisonment. In cases of systematic evasion or serious violations, a person may be sentenced to imprisonment for a term of up to several years, which is provided for in Article 336 of the Criminal Code.
  • Movement restrictions. A person who is wanted by the TCC may be restricted in his movements, in particular, he may be detained when traveling abroad or when documents are checked on the territory of Ukraine.
