How to correctly fill out the e-declaration of a civil servant?

Officials of local self-government, civil servants, deputies, candidates for civil service, police officers and other categories of civil servants must submit an e-declaration every year. Types of electronic declarations in Ukraine

According to Ukrainian legislation, the following types of declarations of the subject of declaration are distinguished:

  • Annual declaration

The annual declaration is submitted in accordance with the first part of Article 45 of the Law of Ukraine. This declaration covers the reporting year (January 1 - December 31 of the current year).

  • Declaration of "candidate for the position"

Declaration of a person applying for one or another position. Submitted to the election or appointment of a person to a position.

  • Declaration "after release"

Declaration of a person who has ceased activity. Such a declaration also covers the reporting year.

A declaration after dismissal does not need to be submitted in the following cases:

  1. Until April 1, 2022, you got a job that also requires declaration.
  2. Upon dismissal, your declaration covered the period from 01.01.2021 to 31.12.2021 inclusive.
  3. Your position no longer requires declaration. For example, changes were made to the Law or the status of a legal entity.
  • Declaration "before release"

Declaration of a person ceasing activity. It is submitted no later than 20 working days after the termination of activity. The day of termination of activity is the last day of performance of public functions by the entity.

Features of submitting an e-declaration

The main body that monitors the submission of e-declarations by civil servants is the National Agency for the Prevention of Corruption (NACP). If a civil servant ignores the requirement to submit electronic declarations, this leads to criminal liability. We are talking about untimely submission of the declaration without valid reasons. First comes administrative responsibility (Article 1726 of the Criminal Procedure Code), then criminal (Article 3663 of the Criminal Code of Ukraine - for intentional failure to submit a declaration).

If certain errors were made in the declaration, a corrected declaration can be submitted within seven days from the moment of submission of the first declaration (part four of Article 45 of the Law). Important: you should describe in detail the errors or detected inaccuracies, explain the reasons for providing false information, if available, add supporting documents.

The e-declaration shall include the following data:

  1. Personal data of the declarant.
  2. Place of work (except military personnel).
  3. Property (movable/immovable property, securities).
  4. Income of the declarants and their family members, monetary assets.

When filling out the declaration, you should take into account the recommendations of the National Agency for the Prevention of Corruption.

  • All necessary information for filling out the electronic declaration must be available.
  • It is worth checking access to the Register, e-mail and qualified electronic signature. The validity period of the KEP certificate must be valid.
  • It is better not to delay the beginning of filling out the declaration. For example, when a large number of people start working at the same time, the system can fail.
  • It is necessary to check the information entered in the declaration.

Important - in accordance with the fourth part of Article 52 of the Law of Ukraine, the obligation is defined:

It is mandatory to report changes in property status within ten days from the moment of acquiring property, receiving income or making expenses in an amount that exceeds 50 subsistence minimums established by current legislation for able-bodied persons.
