Basic steps for buying a plot of land in Poland

Selection of land plot

  • Find a suitable plot of land through real estate agencies or on your own.
  • Check the legal status of the plot (whether it is under mortgage, encumbrance, etc.).

Obtaining permission

  • Foreigners who are not citizens of EU countries must obtain permission to buy land in Poland from the Ministry of the Interior and Administration (Ministerstwo Spraw Wewnętrznych i Administracji).
  • To obtain a permit, you need to submit an application and add the necessary documents, in particular, justification of the need to purchase land.

Conclusion of a preliminary contract

  • After choosing a plot and obtaining the necessary permission (if needed), a preliminary sales contract is concluded with the owner of the plot.
  • This contract defines the main terms of the agreement, including the price, performance period, etc.

Legal review

  • Carry out a thorough legal inspection of the land plot (due diligence).
  • Check the land register (księga wieczysta) to make sure there are no encumbrances or other legal problems.

Signing a notarial contract

  • The purchase agreement is drawn up in the presence of a notary public.

  • After signing the notarial contract, it is necessary to register the right of ownership in the relevant land cadastre.
