How to become the sole guardian of a child

The issues of guardianship of children during the martial law period are becoming widely relevant.

This is explained by the fact that many children who have not reached the age of majority (18 years) lose their parents in connection with hostilities on the territory of Ukraine and need the appointment of a guardian or custodian over them. However, not every citizen knows how to become the sole guardian of a child.

What is the difference between custody and care?

If guardianship is established for minor children (aged up to 14 years), then guardianship is established for minor children (aged 14 to 18 years).

It is worth noting that custody and care is established only for those children who were deprived of parental care or became orphans.

How to become a guardian for a child?

To issue guardianship over a child, you need to follow the following algorithm of action, namely:

• Contact the children's service at the place of actual residence of future guardians with a written application. In the application, you should indicate the desire to register custody of the child.
• Collect the necessary package of documents, which consists of identity documents; RNOCPP; salary certificates of the future guardian for the last six months; marriage certificate (if the person is officially married); a medical report certifying the current state of health of the future guardian; a certificate of no criminal record; documents on ownership of real estate; documents showing the actual place of residence of the future guardian; a certificate from a psychiatrist and narcologist certifying the absence of any addiction in the future guardian. A complete package of documents is usually considered in 5 days.
• Check the living conditions. This stage is necessary in order to check the current living conditions of the future guardian. Based on the results of the inspection, a corresponding act of inspection of housing conditions is drawn up.
• Train future guardians(applies to those persons who are not close relatives of the child). At this stage, appropriate courses are held for future guardians regarding the training of orphans and those who have been deprived of parental care in the appropriate institution determined by the body of guardianship and guardianship.
• Sign up for potential guardians. After checking all the necessary documents and taking courses, the Children's affairs service registers citizens in the register of potential guardians and also prepares a conclusion on the feasibility of establishing guardianship over a child.
• Appointment of guardianship over a child. After the appropriate opinion has been drawn up by the children's affairs service, a decision is made to appoint guardianship over the child within one month after the relevant body of guardianship and care learned about the need to establish guardianship over the child.
