How to be released from criminal responsibility?

In what cases is exemption from criminal liability possible?

In accordance with the requirements of the current Ukrainian legislation, namely the Criminal and Criminal Procedure Codes of Ukraine, exemption from criminal liability occurs on a number of grounds. Among them is the application of amnesty or the expiration of the statute of limitations. In addition, there are special types of exemption from punishment, in case of committing certain types of crimes. We are talking, for example, about the decriminalization of certain components of crimes.

Almost all types of exemption from criminal responsibility have common features, namely, a significant reduction or loss of the public danger by the guilty person.

Part 4 of Article 212 of the Criminal Code of Ukraine states that a person charged with criminal liability shall be released from it if he has paid fees and taxes, as well as compensated for the damage caused to the state by late payment of mandatory payments (fines, financial sanctions, etc.).

A very important stage in this regard is the stage of the criminal process. At this stage, the suspect can compensate the state for material damage, etc.

The suspect must understand that his release from criminal responsibility does not imply release from the obligation to compensate for the damage caused by the criminal offense. The exception is Article 46 of the Criminal Code of Ukraine.

According to Article 127 (parts 1 and 7), a person who has suffered moral or property damage as a result of a criminal offense has the right to file a lawsuit against the accused/suspect even before the trial begins.
