How to adopt a child from a second wife?

As a result of various life circumstances, situations occur when the child's father or mother enters into a new marriage and creates a family with another person. First of all, a person who wants to become a father or mother of a child must apply to the children's service - the involvement of this state body in this case is mandatory. In addition to the application, it is necessary to collect a package of documents specified by law.

One of the key points for obtaining a positive conclusion on adoption is:

  • the presence of a notarized written consent of the child's parents;
  • the consent of the child's father/mother and a document that establishes the absence of the child's second parent (it can be a death certificate, a court decision on deprivation of parental rights, on recognition of a person as incapacitated or missing, etc.).

If the future adopter is a foreigner, the procedure remains the same as for Ukrainians, but an additional check is carried out for the presence or absence of compromising information in law enforcement agencies.

The Children's Affairs Service receives the application and within ten days checks the submitted documents, living conditions, can hold a conversation and find out whether the child agrees (if he is aware of the fact of adoption and can independently express his opinion) and, based on all the data received, forms a conclusion about the possibility of adoption.

Another integral stage of the procedure is applying to the court for adoption. On the basis of the court decision, which has entered into legal force, the applicant acquires parental rights and responsibilities for the child, the spouses can make changes to the act record of the child's birth.
