How to adopt a child from a maternity hospital in Ukraine

How can you adopt a child from a maternity hospital in Ukraine?

First of all, it should be noted that the Family Code of Ukraine establishes the obligation of parents to pick up a child from a maternity hospital (a medical and preventive institution that provides obstetrical, gynecological, and neonatological inpatient care) or another medical institution (Article 143 of the Civil Code).

This duty rests on the child's parents, who are officially married, as well as the mother and father, who are not married to each other. If the child is not taken from the maternity hospital by its biological parents, then its close relatives have the right to take such a child into custody, but in this case, it is necessary to have permission from the body of guardianship and guardianship.

Importantly! If no one came to pick up the child from the maternity hospital, including her parents, close relatives or other family members, then she is considered to have been deprived of parental care and can be adopted.

Also, it is worth noting that from the analysis of Art. 209 of the Civil Code, it can be said that the legislation allocates 2 terms for the adoption of a child who was not taken or found in the maternity hospital, namely:

  • If the child was abandoned by his parents, other close relatives, and family members, he can be adopted only after he reaches the age of two months.

This deadline is set because the parents may be in a certain affective state, because the newborn child was not wanted, and thus individuals need time to make the final decision to accept or reject the child.

Also, the reason for the abandonment of the child by close relatives and other family members may be their lack of information about the fact of the birth of the child and its stay in the maternity hospital.

  • If the child was abandoned or found on the territory of a maternity hospital or other medical institution, it can be adopted only after 2 months have passed since its discovery.

The legislator sets such a period in order to find the child's biological parents or other close relatives since their whereabouts are unknown and they cannot exercise their legal right to refuse the child or adopt it into the family.

In addition, in such a case, the employees of law enforcement agencies of the National Police and the maternity hospital or health care institution draw up a corresponding report, which indicates the time and place of the child, under what circumstances it was found, and by whom. On the basis of this act, the child will be placed in a children's institution as a permanent place of residence, as well as future adoption.

Importantly! After these terms expire, a person has the right to apply to a judicial authority for the purpose of adopting a child from a maternity home.
