HOW DOES A MILITARY PERSON OBTAIN LEAVE?
The war left its mark on every family. But it is most noticeable for military personnel who are on duty. There are those who have not been on vacation for many months. And a logical question arises as to how to get leave for the military, where to apply and many other questions.
First, it is worth understanding what types of vacations a military serviceman is entitled to.
- Annual basic leave. During martial law, only part of it is provided. The duration cannot exceed 10 calendar days.
- Leave for family reasons. The duration of which cannot be more than 10 days.
- Leave in connection with childbirth and child care until the child reaches the age of three. This type of leave is more relevant for female military personnel.
- Leave due to illness or for treatment after a serious injury.
How does a military person obtain leave?
Submit a written report to the unit commander with a request to grant leave. In the report, indicate the type of leave and its duration.
If it is a leave due to family reasons, add documents to the report confirming such circumstances, for example, the birth of a child, stay for treatment of close relatives, etc.
In the report, the serviceman's direct superiors must put their resolutions that they are not against granting such leave.\
Then the report is sent to the commander of the military unit, who makes a decision on granting or not granting such leave.
If the decision to grant leave is positive, the serviceman is issued an extract from the order on granting leave indicating its type and duration.
Recommendations
It is recommended to submit the report in two copies. Submit one to the military unit, and keep the other with the receipt number. It is also worth noting that 10 calendar days of leave are granted without taking into account the travel time from the place of service and back. Travel time is given no more than 2 days in one direction.
Can they refuse to grant leave?
The decision to grant or not to grant leave is made by the unit commander. One of the reasons for the refusal may be that about 30% of the total number of servicemen of a certain category of the relevant unit are already on leave and the granting of leave to other servicemen is possible after the return of their comrades.
Importantly! Upon arrival on leave, a military serviceman must report to the territorial department of the TCC and SP no later than the next day in order to be registered.
So, as can be seen from the above, it is possible to get a military leave even during martial law. But for this you need to know what such a right is and be able to realize it. And in case of controversial or problematic issues, use professional legal assistance.
