At the same time, it's important to understand that such actions are not always legal. A person is placed on the military registration and enlistment office's wanted list for violating military registration rules or failing to comply with mobilization legislation.   1. The fastest option is to use the "Reserve+" app. In this case, the applicant submits an application online, receives a ruling on the administrative offense, and pays the fine. After payment, the data is automatically updated, and the wanted list is removed. However, you understand that this method requires admitting the offense, effectively making you an administrative offender. This method also does not guarantee that you won't be placed on the wanted list again for another offense in the future.
  2. Submitting an official application to the military registration and enlistment office requesting the removal of the illegal wanted list. Typically, such an application is submitted by registered mail with a description to ensure the military registration and enlistment office receives it.
  3. An alternative is to apply through a lawyer. The representative will handle all communications, prepare the documents, and oversee the removal process.
  4. Another optimal solution is a court appeal. If the TCC's actions are proven to be unlawful, the wanted list is subject to cancellation by a court decision. In most cases, the military registration and enlistment office commits procedural violations, such as missing the statute of limitations, failing to deliver the summons, etc., and therefore the court rules in favor of the plaintiff.

Important! Please understand that in many cases, the second and third methods do not always yield a guaranteed result due to the TCC ignoring such requests altogether and failing to respond. At the same time, there are situations where a repeated entry is unfounded, and therefore, in such cases, the military enlistment office's actions are subject to appeal.

Judicial practice and appeals against the search of the TCC

An analysis of judicial practice reveals a positive trend regarding appeals against wanted lists. In most cases, courts side with plaintiffs provided they establish the absence of proper grounds for placing the individual on the wanted list.

For example, in cases № 380/15018/25, № 200/6077/25 and № 600/2277/25-a, the courts concluded that:

  • the failure to properly serve a summons makes it impossible to prosecute;
  • entering data into the Oberig registry without a warrant is illegal;
  • the TCC's failure to properly contact the police does not create grounds for a search;
  • the presence of a deferment and updated data also precludes the legality of such actions.

In fact, it can be concluded that the entry in Reserve+ itself is not proof of guilt, but only a technical element.

  1. Analysis of the grounds - it is necessary to determine the basis for your inclusion on the wanted list: whether a summons was issued, whether a report was drawn up, whether a ruling was issued.
