How can a student get a deferment from mobilization?
In today's environment, the issue of deferral from mobilization for students has gained special attention. Given the significant number of people studying in higher education institutions, it is important to understand what legal provisions regulate this issue, what documents must be submitted and what conditions must be met to obtain a deferment.
Who can get a deferment due to studying?
- Persons undergoing vocational education and subject to military service;
- Students pursuing professional higher education and subject to mobilization;
- Persons enrolled in higher education institutions and liable for military service;
- Applicants for a doctoral degree;
- Persons enrolled in an internship.
Important! A prerequisite is that students must study full-time or dual enrollment and obtain a level of education higher than the previous one, in accordance with Part 2 of Article 10 of the Law of Ukraine "On Education".
In order to obtain documents confirming the completion of an educational level, a person must apply to an educational institution to obtain the relevant document, in particular:
- certificates from the place of study, which indicate the status, form of study and sequence of educational level;
- certificates of enrollment in an internship;
- a certificate of employment confirming his/her position as an intern at a healthcare facility.
Features and procedure for obtaining a deferment from mobilization for a student
- Preparation of the application: The student must draw up an application for deferment addressed to the head of the TCC and JV Commission in accordance with the form specified in Annex 4 of the CMU Resolution № 560 and submit it in person together with the originals or notarized copies of documents confirming the right to deferment on the basis of study.
- Consideration of the application: The TCC and JV Commission reviews the submitted documents and assesses the legitimacy of the grounds for granting the deferral. Also, if necessary, the commission has the right to contact state authorities to obtain additional information or use data from electronic registers that are publicly available.
- Decision-making: The decision to grant or deny an extension is formalized in the form of a commission resolution. The deadline for making this decision is 7 days from the date of registration of the application, but no later than the next day after receiving the information on the requests.
- Notification of the decision: The TCC and JV Commission informs the student of the decision no later than the day following its adoption by means of communication. In the case of a positive decision, the student must personally appear at the TCC to obtain the relevant certificate. In case of refusal, the student is notified of this. If the person does not agree with it, he/she has the right to appeal this decision in court.
