HOLIDAYS FOR MILITARY SERVANTS. HOW TO GET A DESERVED REST?

The full-scale war in Ukraine has been going on for almost ten months. During this time, thousands of soldiers were mobilized. But after serving the specified term, not everyone was able to get at least a short-term rest. Not everyone exercised their legal right to a well-deserved rest. Since the beginning of the war, changes have been made to a number of normative legal acts, among which the changes affected the vacations of military personnel. In particular, during the period of martial law, all types of leave for military personnel are postponed to the next period, or instead of such leave, you can receive monetary compensation. An exception was family leave of up to 10 days, but again, not everyone could take advantage of it.

But on December 1, 2022, the Verkhovna Rada of Ukraine adopted a law according to which military personnel have the right to part of their annual leave and leave for family reasons.

Types of vacations and their characteristics

Part of annual basic leave

Although, according to the legislation, military personnel have the right to increase the duration of their annual basic leave, they can use only a part of it during the period of martial law. The other part is carried over to the next year or, if desired, to receive monetary compensation for it.

Leave for family reasons

Such a leave can be granted to a serviceman in the presence of certain life or family circumstances (marriage, birth of a child, illness of close relatives, etc.). That is, if there is a valid reason, a serviceman can use such leave.

Duration

Each of the above-mentioned vacations can be granted for a period of no more than ten days. Leave can be granted for a shorter period, it all depends on whether the commander of the leave comes for 10 days or less. Leave of shorter duration can be granted, but longer - not. That is, a military serviceman can receive a vacation in the amount of no more than 20 calendar days during the year. This term does not include the time that will be spent on the road from the place of service and back.

Payment

According to the adopted Law, both vacations are paid, i.e. military personnel are provided with financial support.

How to get?

As in peacetime, leave is granted on the basis of a serviceman's report. If it is a leave due to family circumstances, then you can add documents to confirm such circumstances (excerpts about the health of loved ones, birth certificates, etc.).

When can I get it?

The law was adopted on December 1, 2022 and will enter into force the day after its publication. That is, as soon as the Law is published, military personnel will be entitled to part of the annual basic leave.
