GROUNDS FOR REFUSING TO PROVIDE A TEMPORARY RESIDENCE PERMIT IN UKRAINE

Obtaining a temporary residence permit in Ukraine means the right of a foreigner or stateless person to legally reside in Ukraine.

But it's not always easy to get the view. There is a list of legally defined grounds, according to which the territorial bodies of the State Migration Service refuse to receive it for the applicant. Of course, in each case the grounds are different, but even the incorrect execution of the application can serve as a basis for refusing to obtain a temporary residence permit.

In particular, these grounds are:

  • First, the applicant has a valid permanent residence permit or a valid refugee permit. It is clear that under such conditions it is impossible to obtain a temporary residence permit.
  • Secondly, the applicant violated the period of legal stay in Ukraine. This means that the foreigner has violated the legislation of Ukraine and is illegally on the territory of the state. Also here can be attributed such grounds as a ban on entry into Ukraine, forced deportation from Ukraine or other unexecuted court decision.
  • Thirdly, the applicant provided false information that is not supported by data from other sources (usually data from Registers and file cabinets).
  • Fourthly, the applicant is a citizen of Ukraine. Citizens of Ukraine already have the legal right to be in it, so obtaining a certificate in this case is not required.
  • Fifth, the application was submitted by a representative without confirmation of his authority.
  • Sixthly, the applicant submitted documents not in full or missed the deadline for obtaining a temporary residence permit in Ukraine.
  • Seventhly, the territorial subdivision of the State Migration Service received information from the law enforcement agencies of Ukraine that the applicant's actions could pose a threat to national security or the life and health of citizens of Ukraine.
  • In the eighth case, when checking the documents of the applicant, it will be established that they are fake or invalid.
  • Ninth, the applicant provided false information in his application.
  • Tenth, when checking the application and the documents attached to it, it was established that the applicant does not comply with the decision of the court or other competent authorities.

The above list of grounds is not exhaustive, there may be others that will serve to refuse to grant a temporary residence permit. After all, each appeal is individual and in relation to each application is checked by the authorities of the Voluntary Health Insurance.

But do not forget that the decision to refuse to grant a visa can be appealed by the State Migration Service or in court.

In order to properly analyze the decision to refuse to grant a temporary residence permit, you should use the help of a lawyer in migration law. Since sometimes the facts stated in the decision may not be entirely clear to a foreigner or a stateless person.

It should also be remembered that the law limits the time limit for applying to an administrative court to appeal against the decision of a subject of power. It is 6 months from the moment when the person found out that his right was violated.
