Grounds for acquiring Ukrainian citizenship

Acquiring Ukrainian citizenship is a matter that is carefully regulated by current legal acts. In particular, an exhaustive list of grounds for acquiring Ukrainian citizenship is provided for in Art. 6 of the Law "On Citizenship of Ukraine". Let's get to know them in more detail.

How to get citizenship of Ukraine?

So, citizenship can be acquired:

• by birth and territorial origin;
• as a result of acceptance or renewal of citizenship;
• as a result of adoption or establishment of care or guardianship over a child;
• due to the fact that both parents of the child are citizens of Ukraine;
• in connection with the recognized or established fact of motherhood or paternity.

It can also be about other grounds provided for by international treaties to which Ukraine has joined. This applies to agreements regarding the simplified procedure for changing citizenship.

Each of these grounds is detailed in the mentioned law. For example, when it comes to citizenship by birth, it applies not only to children born to citizens of Ukraine, but also to children born to foreigners who have been living on the territory of Ukraine for a long time on legal grounds. This legal norm also applies to so-called finds - newborn children found on the territory of Ukraine, whose parents are unknown.

How is acceptance of Ukrainian citizenship carried out?

If a person wants to accept the citizenship of Ukraine, he must meet the requirements set forth by the current legislation. In particular, it refers to Art. 9 of the Law "On Citizenship of Ukraine". Therefore, such a person must recognize and adhere to the Constitution and current laws of our country. She must, in accordance with the procedure established by law, submit a declaration about the absence of foreign citizenship or an obligation to terminate it.

Also, such a person must legally reside continuously on the territory of our country for at least 5 years. When it comes to a person who came to Ukraine without having any citizenship, it is 3 years. The beginning of this term can be calculated in 2 ways - from the moment of recognition as a stateless person or from the moment of entry into the territory of Ukraine.

Other requirements include having an immigration permit, legitimate sources of income, and knowledge of the official language at a level sufficient to communicate in it.

The date when a person is admitted to the citizenship of Ukraine is the day when the corresponding Presidential Decree is issued.
