Extradition of a person who has committed a criminal offense (extradition in Ukraine)

Extradition is a process involving international cooperation to extradite an individual to a state. The main goal is to bring the accused to criminal liability and the execution of the corresponding sentence.

Proceedings related to extradition

The extradition procedure includes the following procedural steps:

• Detention of a person accused of committing crimes outside of Ukraine (Article 582 of the Code of Criminal Procedure of Ukraine).
• Temporary arrest (Article 583 of the Code of Criminal Procedure of the Russian Federation).

Temporary arrest provides for the detention of a person wanted for a crime outside of Ukraine. The period of temporary arrest is determined by international agreements and lasts most often until a request for extradition (extradition of a person) is received.

• Extradition arrest (Article 584 of the Code of Criminal Procedure of the Russian Federation).

Extradition arrest is the application of precautionary measures in the form of detention of the accused in order to be able to extradite him. The period of arrest may last no more than 12 months: from the decision on the extradition of a person to his actual extradition.

• Extradition verification (Article 587 of the Code of Criminal Procedure of the Russian Federation).

This procedural action is carried out at the request or instruction of the Central Authority of Ukraine and provides for the verification of circumstances - obstacles to the extradition of a person. The extradition check takes about two months.
