Evasion from military registration

During martial law, it is the duty of every citizen to comply with the rules of military registration. Evasion of registration not only violates the law but can also lead to serious legal consequences.

Features of military registration in 2024

In Ukraine, military registration is divided into three types: registration of conscripts, persons liable for military service and reservists. It is kept at the place of residence and is divided into:

• personal-qualitative, which includes all the information of citizens entered in the Register of Persons Liable for Military Service;
• personal-primary, which is kept at the place of registration, especially in villages and towns without appropriate recruitment centers;
• personal, which is kept at the place of work or study.

The register of citizens temporarily residing outside Ukraine is regulated by the Cabinet of Ministers of Ukraine.

According to the Rules of Military Registration, persons must be registered according to their place of residence. The TCC and JV maintains personal and qualitative records of persons and provides a military registration document based on this information.

Checking information on registration

During mobilization actions, representatives of the CMC and JVs, police officers and the State Tax Service check military registration documents of citizens aged 16-60, including the following information

• Determining the status of a person in the Register.
• Verification of personal information and data in the military registration document with the Unified State Register.
• In case of detection of evasion and discrepancies, the alert group offers to visit the military enlistment office to undergo a military qualification examination and clarify credentials, issuing a summons. If the person refuses to receive it, a refusal act is drawn up.

If the person does not agree to go to the military enlistment office, the police officer has the right to carry out an administrative detention and take him to the appropriate center.

What is the responsibility for failure to comply with the rules of registration of persons liable for military service?

• Administrative liability - Article 210 of the Code of Administrative Offenses

Evasion of military registration is punishable by fines ranging from UAH 17,000 to UAH 25,500.

The TCC and the JV are authorized to consider this offense and impose penalties. They can immediately impose a fine, which must be paid within fifteen days. If the payment is not made on time, the fine is doubled (UAH 34,000-60,000) and enforced by the executive service.

• Criminal liability - Art. 336, Art. 336-1 and Art. 337 of the CCU

If a person evades military duty after receiving a warning from:

1. authorized representatives of the TCC and JV;
2. heads of territorial bodies of the SSU;
3. heads of the SZR of Ukraine;

the law provides for the imposition of fines of up to 500 non-taxable minimum incomes or correctional labor for up to 1 year. If a person liable for military service refuses to attend training, the penalty is a fine of up to 700 minimum wages or correctional labor for up to 2 years.

Evasion of conscription and service during the war is punishable by imprisonment for up to 5 years.

Ways to evade military registration

1. Sustaining physical injuries, including intentional harm to health, which leads to an inability to perform military duties.
2. Artificially creating symptoms or falsifying data to obtain a diagnosis that exempts from service.
3. Falsification of medical certificates or other official documents.
4. Using fictitious reasons or false information to avoid registration.
5. Open and deliberate failure to comply with the requirements of the military registration and enlistment office.
6. Actual non-arrival to the TCC and JV.
7. Refusing or ignoring a summons.
