ENTERPRISE CRITERIA FOR EMPLOYEE BOOKING

Even during the war, the country's economy must work. And for this it is necessary that enterprises work. After February 24, 2022, the issue of booking conscript workers at enterprises has become acute. After all, not all fields of work can be performed by women, there are enterprises that cannot do without men's hands.

But in order to avoid abuses by those enterprises that do not have a strategic importance for the economy, in February 2023, the Ministry of Economy, by Order No. 952 dated 02.17.2023, approved the Criteria for determining enterprises, institutions and organizations that are important for the branches of the national economy. That is, the criteria of enterprises that can book conscript workers were approved, but these criteria will come into effect on March 14, 2023.

Criteria for enterprises:

• Providing support and support for investment projects in accordance with the decision of the Cabinet of Ministers of Ukraine or the Ministry of Economy;
• Carrying out, in accordance with the laws of Ukraine, the implementation of state policy, for the formation of which the Ministry of Economy is responsible;
• receiving financial state support in the form of grants in accordance with the legislation of Ukraine;
• Performance of work or provision of services for the Ministry of Economy on a contractual basis, but only if such contracts are concluded for a period of at least six months;
• If the enterprise is directly in the field of management and fulfills government orders;
• The enterprise operates on the territory of three or more regions of Ukraine in the field, the formation and / or implementation of the policy of which is provided by the Ministry of Economy;
• The enterprise produces such a type of production or provision of services that meets the needs of other enterprises, institutions, organizations in material and technical resources, raw materials and components, the absence of which will lead to a complete halt in the production of products or the provision of services in the field of policy formation and / or implementation provided by the Ministry of Economy.

That is, if an enterprise falls under at least one of the above criteria, it can apply to the Ministry of Economy for granting it such a Status.

The decision to grant the status of an enterprise that meets the criteria must be set out in writing. If an enterprise is denied a status that meets the criteria of the Ministry of Economy, then the refusal must describe in detail the reasons for such a refusal.

Having received the status of an enterprise that meets the criteria, the enterprise can book conscripted workers.
