DUPLICATION OF THE ADDRESS FOR THE REAL ESTATE OBJECT

Oleksandr Petrovych addressed the legal company "Prikhodko&Partners" with the following question. Oleksandr Petrovych acquired ownership of the land plot and the residential building located on it by inheritance.

Having started the process of registration of the right of ownership of real estate objects by conducting state registration, the latter faced the refusal of the state registrar to carry out registration, due to the fact that at the address at which the land plot and house of Oleksandr Petrovych are located in the register of property rights another land plot and residential building are already registered. Thus, as we can see, there has been a duplication of addresses for real estate objects.

The procedure for solving this issue is regulated by the Procedure for assigning addresses to construction objects and real estate objects, approved by Resolution № 690 of the CMU dated July 7, 2021.

This procedure determines the procedure for correcting the address of an object of immovable property of both private, communal and state ownership. According to this procedure, if there is a duplication of the numbers of real estate objects, one or more of which are not state or communal property objects, then the change of address correction is carried out on the basis of a court decision.

Taking this order into account, the legal company "Prikhodko&Partners" in the interests of Oleksandr Petrovych first applied to the city council with a statement about correcting the address for the land plot and residential building.

However, the city council refused to make such an adjustment, in connection with which we appealed to the court with a lawsuit against the city council to change the address for the land plot and residential building of Oleksandr Petrovych.

The court satisfied our claim in full, and changed the address to the above-mentioned objects. On the basis of this decision, the state registrar registered the land plot and Oleksandr Petrovych's house at the new address.

Similar problems arise during registration of ownership rights to real estate objects in the process of acquiring their ownership by way of inheritance, in the process of legalizing objects of self-construction, and in other cases. The emergence of such issues is caused by the bad faith of the entities that are engaged in assigning addresses to such objects.
