Documents required for state registration of ownership of real estate

For the state registration of rights a person shall submit:

- statement of the established form;

- a copy of the document certifying the applicant's identity (a passport of a citizen of Ukraine, a residence permit for a person residing in Ukraine, a foreigner's national, diplomatic or service passport or a replacement document);

- a copy of the registration number of the taxpayer's account card in accordance with the State Register of Natural Persons - taxpayers (identification code) (except in cases where the person, because of his religious beliefs, refuses to accept the registration number of the taxpayer's registration card, officially informed the relevant authorities and has a mark in the passport of a citizen of Ukraine);

- a document confirming the payment of the fee for providing an extract from the State Register of Rights (a receipt);

- a document on payment of the state duty (receipt) (except for cases when the person is exempted from payment of the state duty);

- a document confirming the occurrence, transition and termination of real property rights (original and copy), as may be:

1) an agreement entered into in the manner prescribed by law, the subject of which is a real property, the rights of which are subject to state registration, or a real right to immovable property, or its duplicate;

2) a certificate of title to a share in the joint property of a spouse in the event of the death of one of the spouses, issued by a notary or consular office of Ukraine, or its duplicate;

3) a certificate of the right to inheritance issued by a notary or a consular establishment of Ukraine, or its duplicate;

4) the notary has issued a certificate of purchase of property from public auction (auctions) and a certificate of purchase of property from public tenders (auctions), if the public tenders (auctions) did not take place, or their duplicates;

5) certificate of title to immovable property, issued by the state registrar in accordance with the law;

6) a certificate of ownership, issued by the privatization authority to tenants of residential premises in the state and communal housing stock;

7) a certificate of title to real estate or its duplicate, issued before January 1, 2013 by a local self-government body or local state administration;

8) a decision on consolidation of real estate on the right of operational management or economic management, taken by the owner of real estate or by a person authorized to manage such property;

9) a state act on the right of private ownership of land, a state act on the right of ownership of a land plot or a state act on the right to permanent use of land;

10) the decision of the court which has gained legal force in relation to the right of ownership and other real rights to real estate;

11) a court order to approve (recognize) a settlement agreement;

12) testament, which is set up easement on immovable property;

13) the law establishing the servitude for immovable property;

14) a decision of the authorized body of state authority on the return of the object of immovable property to a religious organization;

15) the decision of the owner of the property authorized by him or her to transfer the object of immovable property from the state into communal ownership or from the communal state property or from the private to the state or communal property;

16) other documents confirming the occurrence, transition and termination of property rights and other property rights to real estate in accordance with the law.

If the documents are filed by the representative of the owner, the user in addition to the above listed documents submitted:

- a copy of the document confirming the authority of the representative (a copy of the power of attorney or other document certifying the relations of representation);

- a copy of the document certifying the identity of the owner, the user (a passport of a citizen of Ukraine, a residence permit for a person living in Ukraine, a foreigner's national, diplomatic or service passport or a replacement document);

- a copy of the registration number of the taxpayer's account card in accordance with the State Register of Natural Persons - taxpayers of the owner, the user (identification code) (except in cases where the person, because of his religious beliefs, refuses to accept the registration number of the taxpayer's registration card, officially informed the relevant authorities state authority and has a mark in the passport of a citizen of Ukraine).

The list of documents required for state registration of property rights is not exhaustive, in accordance with Article 9 (2) of the Law of Ukraine "On state registration of real rights to immovable property and their encumbrances", the state registrar of rights, if necessary, has the right to request submission of additional documents.
