On February 24, 2022, martial law was introduced in Ukraine and general mobilization of citizens was announced to replenish the main forces of the Armed Forces of Ukraine and to protect their homeland from an armed attack by the Russian Federation. However, despite the general mobilization, which applies to men between the ages of 18 and 60, there are categories of people who are not subject to conscription. This applies to those citizens liable for military service who have a deferral from conscription, for which there must be legal grounds and documents. This is why the topic is so relevant today. Therefore, in this article, we will talk about what documents you need to obtain in order to be deferred from mobilization.

 

What categories of citizens have grounds for deferment from mobilization?

From the analysis of the provisions of the Law of Ukraine "On Mobilization Preparation and Mobilization", namely Article 23, it is clear that the following categories of citizens are not subject to call-up for military service when mobilization is announced

  • persons who are employed by state authorities, local self-government bodies, as well as other private enterprises in accordance with the procedure established by the current legislation
  • persons enrolled in full-time education, i.e. undergraduate and graduate students;
  • persons in which one of the parents has a disability of group 1 or 2 and needs constant care;
  • persons raising a minor or underage child under the age of 18 on their own;
  • persons who have a dependent adult child with a disability of group 1 or 2;
  • other categories of persons liable for military service.

Please note! The above list does not contain all the legal grounds for granting a deferral from mobilization, as they may change from time to time. Therefore, you should always refer to Art. 23 of the Law of Ukraine "On Mobilization Preparation and Mobilization", taking into account all the latest changes to the said law.

What documents are required to defer mobilization?

Depending on the legal grounds that entitle a citizen to be deferred from mobilization, the specific list of documents to be submitted will vary.

  • Thus, if a citizen is a student or a researcher (postgraduate student), he or she should provide certificates confirming his or her studies at the relevant higher education institution or research institution, a student card, a certificate of enrollment, etc;
  • If the citizen is a reserved employee, he/she should provide an extract from the decision on reservation in the form according to Annex 3 of the Resolution of the Cabinet of Ministers of Ukraine № 76 of January 27, 2023 (usually provided at the place of work);
  • If a citizen has current health problems, he or she should provide a certificate of the results of a medical examination issued by the Medical Care Committee or the Medical Service Commission, documents confirming a disability since childhood (for example, a certificate), etc.
