Current legislation

So, the final provisions of Law № 889 refer to the right to a pension in accordance with Article 37 of the Law of Ukraine "On Civil Service". Namely, Clause 10 of the mentioned provisions determines that civil servants with at least 10 years of experience in positions that belong to certain categories mentioned in Art. 25 of the Law of Ukraine "On Civil Service", in accordance with the procedure defined for persons with at least 20 years of experience. There is also an important norm in clause 12 of these provisions and it concerns civil servants with at least 20 years of experience. In the meantime, let's touch on one more issue, namely the calculation of length of civil service. It is defined in Art. 46 of the Law of Ukraine № 889 and the Procedure for calculating length of civil service, which was approved by the relevant Government Resolution № 229 of March 25, 2016.

It is also significant that Clause 8 of the Final and Transitional Provisions of Law № 889-VIII stipulates that the length of civil service, which refers to periods of work before the entry into force of this normative legal act, is calculated in the manner prescribed by the legislation in force at that time. time. If we detail this issue, we are talking about another government resolution, namely document number 283 dated May 3, 1994.

Therefore, drawing a conclusion from all of the above, it is worth noting the following - the length of service before May 1, 2016 is calculated precisely on the conditions that were provided for at that time. However, in practice it often happens quite differently, since the Pension Fund does not take into account the mentioned norms and refuses to switch to a similar type of pension. This is far from the only category of cases when the PFU does not act in the interests of the pensioner and ignores the current legislation. So we have to defend our rights in court.
