Documents confirming the right to postponement
The Law of Ukraine "On Mobilization Training and Mobilization" provides an exhaustive list of grounds for obtaining a deferment from service in the Armed Forces. At the same time, the norms of military law are regularly transformed, changed, supplemented. This is due to the fact that the dynamics of the war and a certain public demand give rise to the need to adapt the legal framework to the real situation in a specific period of time. For example, the ground for deferment related to caring for an incapacitated relative, if there are other family members who have a duty to provide such care, was recently removed.
The team of the "Prikhodko&Partners" law firm monitors changes in order to represent the interests of its clients as effectively as possible and to provide correct information during consultations.
What documents confirm the existence of grounds for postponement?
There is no clear list of such documents, as there are several reasons. So it all depends on the specific reason you are going to use it. Therefore, we will consider different situations separately. Therefore, the following have the right to deferment from service in the Armed Forces:
- Conscripts whose spouse, husband, parent or child has the I or II disability group, provided that there is no one else to care for such a person. It is necessary to provide documents that confirm marriage or family ties and a certificate of inspection of the MSEK or a pension certificate of the person being cared for.
- Persons with disabilities. Documents confirming the disability group are provided.
Individuals who raise a child independently. It is necessary to provide the child's birth certificate and documents confirming family status (to make it clear that the person is really raising the child alone). - Employees who are booked by state enterprises, institutions or organizations. Documents are provided that confirm the fact of labor relations and armor.
- Persons who have 3 or more minor children to support. Children's birth certificates are key documents in this case. When one child or several children are from the first marriage and live separately, the fact of maintenance can be confirmed by documents testifying to the payment of alimony.
- Full-time or dual-time students, postgraduates and doctoral students. The order on admission to study at a university confirms the existence of this basis.
- Scientific and scientific-pedagogical workers with a load of at least 0.75 rates. It is necessary to provide documents that confirm the employment relationship (for example, an employment contract and an employment book).
- Persons whose close relatives died in ATO or during a full-scale war. A death certificate of such a person, as well as other documents testifying to the circumstances of the death and the fact of family ties, is provided.

Quality legal support is a guarantee of justice
Despite the fact that the legislation clearly defines the list of reasons for postponement, in real life a person often faces problems. An insufficiently clearly prescribed list of documents to confirm each of the reasons makes it possible for abuse by officials of the military commissions.
