Since the beginning of the full-scale invasion, the topic of mobilization has become one of the most pressing issues in Ukrainian society. Along with general questions about conscription, more complex topics, such as the mobilization of people with disabilities, are also being discussed. Many people, including those with certain health problems, want to understand whether they are subject to military service.

According to Ukrainian legislation, in particular the Law of Ukraine “On Mobilization Training and Mobilization” and other regulations, citizens who are fit for military service are subject to mobilization. However, there are certain restrictions and exceptions that apply to persons with disabilities.

 

This raises the question, what is the main thing and what distinguishes disability groups from each other?

This is the degree of deterioration of the health condition. Thus, persons in group 1 have the most severe disability, and such a person is completely disabled and needs constant outside care.

In turn, group 3 is the mildest degree of disability. In other words, this disability group in Ukraine usually means a moderate disability, which does not necessarily exclude the possibility of performing certain activities, including military duties.

One of the most frequently asked questions is about the mobilization of persons with disability group 3.

  1. However, it should be remembered that exemption from mobilization does not mean automatic removal/exclusion from military registration.
  2. Persons with disabilities of group 3, like all other persons liable for military service, remain registered with the TCC and the JV.

Is it true that persons with disabilities can get a deferment?

Yes, it is true that persons with disabilities in Ukraine can receive a deferral from mobilization.

According to Article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization”, persons recognized as persons with disabilities in accordance with the established procedure are exempt from military service. This applies to all disability groups, including group 3.

When applying to the MCC and JV for a deferment, it is important to have documents confirming the disability. This can be a disability certificate, a certificate of disability group and other necessary documents.

You can be mobilized only by voluntary consent.
