Divorce online. What is the algorithm of actions

In the conditions of global digitalization, our society is increasingly accustomed to providing services remotely, that is, online, because it is convenient and saves a lot of time.

However, unfortunately, not all citizens can use such services, because they do not know how they function in everyday life, for example, divorce between individuals in an online format.

This topic is becoming more and more relevant today since the number of Ukrainian citizens who want to dissolve their marriage without leaving home is constantly growing because not everyone has the physical or technical ability to appear before the relevant state authorities for this procedure.

Is it possible to file for divorce online in 2023?

Yes, as of 2023 in Ukraine, a married couple who wants to divorce can apply for a divorce online through the court or the RACS authorities.

In addition, it is worth noting that a marriage can be dissolved through the RAC when a married couple does not have joint children who have not reached the age of majority (18 years of age) and no one objects to the dissolution of such a marriage.

If a man and a woman do not want to divorce or have common minor children, then in this case they will need to turn to the judicial authorities.

How to file for divorce online through the RACS authorities?

If individuals have decided for themselves that the best option for them would be to file a divorce online, then they should submit a corresponding online application through the website of the Ministry of Justice of Ukraine. To do this, you will need to register on the website in advance and provide clear copies of the following documents:

• passport of each spouse;
• marriage certificate;
• a document confirming the payment of state duty.

Importantly! At least 30 days must have passed since the time when the married couple submitted the appropriate online application for divorce through the RACS authorities.

After the expiration of this term, the RATS authorities set a date for the dissolution of marriage, on which the married couple will have to come to the RATS authorities in order to obtain a divorce certificate.

How to file for divorce online during martial law in court?

To do this, you need to file an application for divorce online through the "Electronic court" system, having previously registered in it and issued an electronic digital signature.

After registration, you will be able to fill out all the necessary documents for opening a case on your claim, as well as pay the court fee and attach all the necessary attachments.

After you have completed the entire algorithm of actions indicated above, the system will allow you to monitor the status of your case, with the possibility of receiving relevant notifications about the progress of the case.

Importantly! As well as when submitting an application online through the RATS authorities, it is possible to partially dissolve the marriage online through the judicial authorities.

The legislation of Ukraine provides that the consideration of the divorce case should take place in an offline format with the personal presence of the participants in the case.

Also, the personal participation of the parties in the case must be present when a copy of the court decision on divorce is issued.
