The search for conscripts or persons liable for military service by territorial recruitment and social support centres (TSC and SP) becomes a problem for many citizens who, for one reason or another, did not show up to the summons. To solve this situation, it is worthwhile to understand how the search system works, what investigative measures to take and what basic legal aspects should be taken into account.

What triggers a TCC and SP wanted manhunt?

The main reason for TCC and SP wanted is the failure of a citizen to appear at the recruitment centre after receiving a summons. Non-compliance with the rules or unawareness of the conscript often becomes the cause of such situations. The main situations that can lead to a search:

  • Failure to receive a summons on various grounds.
  • Evasion from a visit to the TCC and SP without a valid reason.
  • Violation of legislation in the field of military registration.
  • Failure to timely update information about the state of health or place of residence, etc.

Legal aspects of the situation

Ukrainian legislation clearly defines the procedure of interaction with TCC and SP. Failure to receive a summons is not considered an offence, but evasion from coming to TCC and SP with a received summons may be qualified as an administrative or criminal offence.

Articles of the Code of Ukraine on Administrative Offences regulating these issues:

  • Article 210 - Violation by conscripts, persons liable for military duty, reservists of the rules of military registration.
  • Article 210-1 - Violation of legislation on defence, mobilisation preparation and mobilisation.

Articles of the Criminal Code of Ukraine regulating these issues:

  • Article 336 - evasion of mobilisation.

To avoid such situations, the legislation obliges conscripts to periodically update their data in the military commissariat.

How to remove yourself from the military registration and enlistment office's wanted list?

To resolve the situation, the following steps should be taken:

  1. Contact the military registration and enlistment office. Go to the relevant CCC in person with all documents (passport, military ID, summons, if available). If you have moved, check whether your credentials have been updated.
  2. Please provide the reason for your absence. If the absence was objective (health problems, family circumstances), please provide the relevant documents or certificates. For example:
    • Hospital certificate.
    • Documents confirming family circumstances.
    • Certificate of change of residence.
  3. Explain the situation in writing. Write a statement explaining the reasons for your absence. This will help avoid further complications and will serve as an official confirmation of your position.
  4. Update your registration details. If you have changed your place of residence, make sure that your new contact details are entered in the CCC register. This will help avoid further disputes.
  5. Pass a medical examination. If necessary, you may be referred for a medical examination to confirm your health status. If you have any health restrictions, this must be recorded.
  6. Get official confirmation. After being removed from the wanted list, request an appropriate document confirming the resolution of the issue.

What to do if the actions of the TCC and SP violate your rights?

If you believe that the actions of TJC representatives are illegal or violate your rights, take the following actions:

  1. Contact a lawyer. A consultation with a professional lawyer will help you properly assess your situation. This is especially true if:
    • You are unreasonably threatened with administrative or criminal liability.
  2. Complaint to higher authorities. You have the right to file a complaint to a higher authority that controls the activities of TCCs and SPs or authorities. The complaint should contain a detailed description of the situation, date and place of events.
  3. Legal action. In case of serious violations, you can go to court  to protect your rights. This may concern:
    • Violation of the procedure for serving subpoenas.
    • Illegal harassment.
  4. Appeal to the Ombudsman. You can appeal to the Commissioner for Human Rights of the Verkhovna Rada of Ukraine, if you believe that your constitutional rights have been violated.

How to avoid being wanted by TCC and SP?

  • Regularly update your data. If you change your place of residence or state of health, inform the relevant TCC.
  • Keep track of your commitments. Check official communications and respond to summonses in a timely manner.
  • Do not ignore subpoenas. If you receive a subpoena, comply with all the requirements specified in the subpoena.
  • Consult with legal counsel. If you are in doubt about the legality of the TCC's actions, contact a professional for clarification.
  • Keep official documents safe. Always keep copies of all documents that relate to your interaction with TCC.

Solving the problem with TCC and SP tracing is possible if you are ready to act within the law and co-operate with the relevant authorities. Remember that timely actions, consultations with lawyers and open dialogue with TCC representatives will help to avoid conflict situations. Avoiding problems is, first of all, your responsibility and awareness.
