The death of a serviceman in war is an extremely sad and tragic event, because a person who was on the front line or took part in military operations lost his life. This always leads to pain and mourning among relatives, friends and colleagues of the deceased. The authorities and the military usually try to support the family of the deceased during this difficult time by providing assistance and compensation, which may include material support, psychological assistance and other types of support.

However, if there were several military personnel in the family and they died, the tragedy becomes much more global.

Therefore, amendments were made to the Law of Ukraine "On Mobilization Training and Mobilization", which provided for the possibility of receiving a deferment for women and men whose close relatives (husband, wife, son, daughter, father, mother, grandfather, grandmother or relative (consanguineous, brother or sister) died or went missing during the implementation of measures to ensure national security and defense, repelling and deterring armed aggression of the Russian Federation in the Donetsk and Luhansk regions, as well as during ensuring national security and defense, repelling and deterring armed aggression against of Ukraine during martial law.

However, it was impossible to be released on this basis until today.

Therefore, certain changes have recently taken place in the legislation regarding the expansion of grounds for dismissal from military service, which are enshrined in Article 26 of the Law "On Military Duty and Military Service". Namely, release in the event that their close relatives died or went missing during the period of martial law and the given reason is as follows:

"if their close relatives (husband, wife, son, daughter, father, mother, grandfather, grandmother or relative (full-blood, brother or sister) died or went missing during the implementation of measures to ensure national security and defense, repelling and deterring armed aggression of the Russian Federation in the Donetsk and Luhansk regions, as well as during ensuring national security and defense, repelling and deterring armed aggression against of Ukraine during martial law".

 

Death means the death of a person confirmed by official sources as a result of military operations.

Disappearance means that a person cannot be found and there is no confirmed information about his whereabouts or fate.

However, it should be emphasized that this does not apply to civilians who died or went missing during the war.

Yes, several men from one family can serve at the same time, and unfortunately, one of them may die. For example, if a military serviceman has a brother who served and died while defending the Motherland, the other can be discharged from military service by writing a discharge report and attaching documents confirming the death of his relative and family ties.

It should be understood that this applies to the close relatives listed in this article, it means that the brother must be full or not half-cousin, not second-cousin or third-cousin.
