Differences between pre-trade and public procurement

All purchases of goods, works and services to meet the needs of the state or local community in the Prozorro system can be divided into two conditional groups: "sub-threshold" and "above-threshold".
The boundaries of these groups are determined in accordance with paragraph 1 of Article 2 of the Law of Ukraine "On Public Procurement". Thus, if the expected value of goods and services is less than UAH 200,000, and works - UAH 1.5 million. (except for customers operating in certain areas of management), such purchases are considered "sub-threshold" and are carried out in accordance with the Procedure for sub-threshold procurement approved by the Order of SE Foreign Trade of Ukraine dated 13.04.2016 N 35.

If the expected purchase price is equal to or exceeds UAH 200,000. and UAH 1.5 million. for works (except for customers operating in certain areas of management), are considered "above the threshold" and fall within the scope of the Law of Ukraine "On Public Procurement".
"Above-threshold" procurement, in turn, is divided into the following types:
• Open bidding (Section IV of the Law of Ukraine "On Public Procurement").
• Competitive dialogue (Section V of the Law of Ukraine “On Public Procurement”).
• Negotiated procurement procedure (Chapter VI of the Law of Ukraine "On Public Procurement").
Each of the above species has its own characteristics and conditions.
