After standing up for the defense of the country, the least thing military personnel should worry about today is financial security. After all, it is logical that the duty to pay wages on time to persons who defend the country is the duty of the state even in war. But unfortunately, in practice, everything turns out differently. Not all servicemen receive financial support on time. Some receive their salary with a delay of several days, and there are others where the delay is weeks or more. It is clear that if this was a single case, but it happens that the delay of salaries of military personnel occurs systematically.

Normative base

It is worth noting that the payment of wages to military personnel takes place on the basis of the Law of Ukraine "On Social and Legal Protection of Military Personnel and Members of Their Families". At the time of martial law, this regulatory act is a priority under the Criminal Code.

Who is responsible for the payment of wages and for the delay in the payment of wages to military personnel?

If for a civilian the employer is responsible for paying wages, then for military personnel it is the military unit to which the military personnel belongs.

Reasons for delay

There can be several reasons for delay in salary and they are all different. For example, there may be a delay of several days in case of untimely transfer of funds from the state budget to the military unit. Or failure of the responsible person to submit to the financial department of the military unit the record sheet and other documents that are the basis for calculating wages. Another reason for the delay in wages in the current conditions is the untimely crediting of wages by banks to the accounts of military personnel due to the lack of electricity and communication (may occur in some regions).

But whatever the reason for the delay in salary for military personnel, everyone has the right to receive a reward for the work done.

• First, make a verbal or written appeal to your immediate supervisor to find out the reason for the salary delay.
• Secondly, if you do not receive an answer regarding the reasons for the delay, clarify the issue directly with the financial department of the military unit.
• Thirdly, you can contact the hotline of the Ministry of Defense of Ukraine to get information on whether the delay is happening at the state level.
• Fourth, get advice and qualified assistance from a lawyer or military law lawyer.

Therefore, it is worth remembering that regardless of the reasons for the delay in salary for military personnel, they have the right to receive full information about the reasons for the delay and to pay it within the period established by law. And in case of any unclear situations, do not neglect legal assistance. And then it will be faster and more effective to restore the violated right.
