The provision of paragraph 13 of the first part of Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization" enshrines the right to receive a postponement of conscription for military service during mobilization by a woman and a man who have a minor child (children) and a husband (wife), who performs military service under one of the types of military service defined by part six of Article 2 of the Law of Ukraine "On Military Duty and Military Service".
That is, we are talking about a situation in which one of the spouses is already doing military service (it can be both husband and wife) and such a spouse has one or more minor children.

- conscript military service;
- military service by conscription during mobilization, for a special period;
- military service under the contract of private members;
- military service under the contract of non-commissioned officers and non-commissioned officers;
- military service (training) of cadets of higher military educational institutions;
- military service under the contract of officers;
- military service by conscription of officers;
- military service by conscription of reservists in a special period.
In addition, it is also mandatory for such a spouse to have one or more minor children, that is, a child who has not yet reached the age of eighteen.
To take advantage of this right to receive a postponement of conscription for military service during mobilization, it is necessary to apply to the territorial recruitment and social support center where the conscript is registered with the appropriate application and provide supporting documents. Such documents are:
- a certificate of marriage registration with a conscript who is already in military service;
- documents confirming that the conscript is actually doing military service at the time of applying for deferment;
- birth certificate of a minor child.
This right can be used not only by conscripted men, but also by conscripted women who, for example, were released from military service earlier and are in the reserve.
Confirmation that the conscript received a postponement of conscription for military service during mobilization must be a corresponding mark in the military registration document and a certificate of such postponement.
