DEFERMENT OF THE CONSTITUTION FOR TEACHERS AND SCIENTISTS

Today, a fairly common question among the population is the question of going abroad during martial law. This is explained by the fact that after the full-scale invasion of the territory of Ukraine on February 24, 2022, men between the ages of 18 and 60 cannot cross the border freely.

Therefore, in order to preserve the scientific and pedagogical potential of Ukraine, the legislation of Ukraine provided for the possibility of receiving a deferment from military service during the mobilization of scientific, scientific and pedagogical workers.

This is explained by the fact that the labor market needs a wide range of professionals, and in the post-war and post-war period, directly in labor professions. Therefore, creating a skilled workforce is an important part of the country's economy. In view of this, there is a need to continue the training of qualified workers in vocational and technical educational institutions.

However, receiving a deferral is not automatic. It is necessary to understand that the TCC and JV do not always have complete information about the person, his place of residence, work and the corresponding status of the teacher. Based on this, a person who has the right to a deferral, and in this case it is a scientific, scientific-pedagogical and pedagogic employee who works at the main place of work for at least 0.75 of the rate, should apply directly to the TCC and SP with an application for receiving a deferment . Having confirmed this fact with relevant documents, which can be: a certificate from the place of work or a work book.

Based on this, a rather urgent question arises regarding traveling abroad, after receiving a certificate of postponement from the Military Commissariat, whether it is possible and how to implement it. However, receiving a deferment does not automatically mean the possibility of going abroad. Regarding teachers, in this case, such an opportunity is not provided. In accordance with the Decree of January 27, 1995 № 57 Kyiv "On approval of the Rules for crossing the state border by citizens of Ukraine", namely paragraphs 2-6. it is stated that in the event of the introduction of martial law on the territory of Ukraine, the right to cross the state border does not apply to persons defined in paragraph 2 of part three of Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization".
