DEFERMENT FROM MOBILIZATION FOR PARENTS RAISING A CHILD WITH A SERIOUS ILLNESS

The legislator provided for the right to receive a postponement of conscription for military service during mobilization for men and women who are raising a child with a serious illness.

Thus, in accordance with the seventh paragraph of the first part of Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization", conscripted women and men, guardians, custodians, adoptive parents, foster parents who are raising a child are not subject to conscription for military service during mobilization. a patient with severe perinatal damage to the nervous system, severe congenital malformations, rare orphan diseases, oncological, oncohematological diseases, cerebral palsy, severe mental disorders, diabetes mellitus type I (insulin-dependent), acute or chronic kidney diseases of the IV degree, a child who received severe injury, requires organ transplantation, requires palliative care, which is confirmed by a document issued by the medical advisory board of the health care institution.

However, in the second part of the mentioned article, a reservation is made that the mentioned persons can be called up for military service with their consent and only according to their place of residence.

We draw your attention to the fact that the very existence of the specified reason for receiving a deferment from conscription during mobilization does not guarantee one hundred percent that you will not be mobilized.

It is understandable, because how will the employees of the territorial recruitment and social support center know that you have a reason to receive a deferment from conscription for military service during mobilization, if they are not informed about it?

In this case, it is necessary to collect all documents confirming the existence of grounds for obtaining a deferment from military service during mobilization (documents confirming a family or other connection with a child who has a serious illness; the conclusion of the medical advisory commission of a health care institution I, etc.) and apply to the territorial recruitment and social support center, where the personal file of the conscript is located, with the corresponding application.

We emphasize that a timely application to the territorial recruitment and social support center will not only prevent your mobilization, but will also help you to fulfill your obligations stipulated by the Law of Ukraine "On Military Duty and Military Service" and the Rules of Military Registration of Conscripts, Conscripts and reservists, approved by the resolution of the Cabinet of Ministers of Ukraine dated December 30, 2022 № 1487 regarding notification of changes in marital status.
