DEFERMENT FROM CONSCRIPTION FOR PERSONS WHOSE RELATIVES DIED OR WERE MISSING DURING ATO

The current legislation of Ukraine regulates the issue of granting conscripts a deferment from conscription for military service during mobilization, by defining specific grounds for this.

In particular, this right can be used by conscripts, and both men and women, whose close relatives were killed/missing during an anti-terrorist operation.

Thus, in accordance with the fourth paragraph of the third part of Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization", women and men whose close relatives (husband, wife, son, daughter, father, mother, grandfather, grandmother or a relative (consanguineous, non-consanguineous) brother or sister) died or went missing during an anti-terrorist operation.

At the same time, we draw your attention to the fact that such close relatives who were killed/missing during the anti-terrorist operation should also belong to a certain category of servicemen who took direct part in the anti-terrorist operation.

Also, we emphasize that in this norm we are talking about close relatives, the list of which is indicated in parentheses, and this will not apply to any other relatives.

In itself, the existence of reasons for receiving a postponement of conscription for military service during mobilization does not guarantee one hundred percent that you will not be mobilized. After all, how can employees of the territorial recruitment and social support center know that you belong to one or another category of conscript who can use the right to receive a deferment from conscription for military service during mobilization?

In this case, we recommend contacting the territorial recruitment and social support center, where your personal file is located, with an application to grant you a deferment from conscription for military service during mobilization on the above-mentioned grounds. All the more so when the current legislation of Ukraine stipulates the obligation to notify the territorial centers of recruitment and social support about the existence of such circumstances.

 

Such an application must be accompanied by documents confirming all the factual circumstances, the presence of which gives the right to use the postponement of mobilization. Such factual circumstances are:

  • the presence of a family connection with a close relative who died/disappeared;
  • the close relative must be, in particular, a conscript who died or went missing during an anti-terrorist operation.
