DEFENSE TACTICS OF THE CLIENT ACCUSED UNDER ART. 307 of the Criminal Code of Ukraine

Each criminal case is special in its own way. No two cases are identical. Article 307 of the Criminal Code of Ukraine provides for responsibility for the illegal circulation of narcotics. It is under this article that there are many abuses by law enforcement agencies or other persons who wish to harm a specific person.

But it is important for a lawyer that the client's interests are protected as much as possible.

In his work, a lawyer must use such tactical techniques that will correspond to the interests of the client and the rules of lawyer ethics.

Each lawyer in his work uses those tactical techniques that, in his opinion, are the most effective for protecting the client's interests.

Tactics during pre-trial investigation

• First, when defending a client on charges under Art. 307 of the Criminal Code of Ukraine, the lawyer focuses his attention on the smallest details. Starting from the moment when the client was detained. Because many violations of the Code of Criminal Procedure are allowed during detention and other investigative actions. And it is the smallest details that, at first glance, are imperceptible, can play an important role in the case.
• Secondly, depending on the situation, choose the most advantageous position for the client regarding giving evidence or, in a separate case, refrain from giving evidence.
• Thirdly, work not only with pre-trial investigation bodies, but also preparation for future defense in court.
• Fourth, compliance with certain timing, which means submission of certain documents in a specific period. For example, timely submission of a petition or keeping it for some time.
• Fifth, use of all possible advantages in defense, i.e. submission of attorney's requests, assistance in gathering evidence, etc.

Tactics during consideration of the case in court

Consideration of the case in court is one of the final stages of the case. It is at this stage that the future sentence depends on the lawyer's tactics. If the lawyer entered the case at the stage of pre-trial investigation to choose the right defense tactics under Art. 307 of the Criminal Code of Ukraine will be easier for him. It is a misconception that a lawyer is needed only in court, in modern realities a lawyer is needed to represent the client's interests in other authorities as well.

It should be noted that defense tactics may differ from a specific situation. Because it is important at which stage the lawyer enters the process. The earlier the lawyer enters the process, the higher the chances that the client's position will be won.

After all, it is not easy to use tactical techniques when the client has already given evidence that will be used against him in the future or to harm when choosing defense tactics.

But regardless of what tactics the lawyer uses to defend under Art. 307 of the Criminal Code of Ukraine is an important result for the client. That is why it is important not to delay and immediately inform the lawyer about detention or presentation under Art. 307 of the Criminal Code of Ukraine indictment. And then the result of legal protection will be mutually beneficial for both the client and the defender.
