Crossing the border for men – who has the right and the price of accompanying a lawyer at the border

Since February 24, 2022, Ukraine has been under martial law. In accordance with the provisions of the Law, it is prohibited for men aged 18 to 60 to leave Ukraine. Normative basis of the question

The main normative legal act that regulates the departure of men abroad under martial law is the Law of Ukraine "On Mobilization Training and Mobilization". The main thesis of this Law is that men with a deferment from mobilization have the right to travel abroad. In order to cross the border without hindrance, this category of persons must have appropriate documents.

Who has the right to cross the border?

As of August 1, 2023, amendments were made to the Law "On Mobilization Training and Mobilization." According to the changes, the following categories of men (from the age group of 18-60 years) have the right to leave:

• Men who are on permanent residence abroad (at the same time, there must be a mandatory mark in the passport).
• Excluded from military registration due to health.
• Persons who have the right to leave for family reasons (we will consider them below).
• Military personnel undergoing treatment or rehabilitation.
• Drivers, volunteers who have appropriate permits.
• Single parents and parents with many children.

Let's take a closer look at the category "persons who have the right to leave for family reasons." We are talking about men who accompany:

1. The wife is a person with a disability.
2. His parents or his wife's parents from among persons with disabilities of the 1st or 2nd group.
3. Other persons who need constant care (this must be confirmed at the legislative level).

Important: to leave Ukraine during martial law, conscripted men must document the reasons for leaving. At the same time, only those who are going to cross the border due to their health should take appropriate documents to the TCC. In this case, the document will serve as confirmation of the person's removal from military registration. All other documents are provided by civil bodies and institutions.
