Crossing the border for family reasons

From February 24, 2022, martial law was introduced in Ukraine, which significantly changed the personal and family life of every citizen of the state. Citizens faced significant challenges, restrictions and difficulties related to maintaining family ties, returning to relatives who had previously left abroad, and ensuring the protection of their loved ones. In this case, the issue of crossing the border due to family circumstances becomes relevant.

From the moment when martial law was introduced on the territory of our country, the issue of citizens leaving the country began to be regulated by the Rules of crossing the state border by citizens of Ukraine.

Analyzing this NPA according to family circumstances, the following persons can cross the border:

  • who have a mother or father of the first degree of kinship, as well as parents of spouses (both from the husband's side and from the wife's side), who are disabled persons of the 1st and 2nd groups and plan to cross the border accompanied by one of such parents.

However, in order to leave the country on this basis, it is necessary to have a number of the following documents, which must be notarized:

  1. a certificate, which will indicate that such a person is really a son or daughter of a person with a disability (that is, will confirm their family ties and the degree of kinship);
  2. documents that will confirm the disability of such persons;
  3. a certificate that will contain data on the same place of actual residence of persons who plan to go abroad and their parents (this can be an act that officially establishes the fact of care, or documents that confirm the receipt of funds for providing care).
  • who do not provide temporary care for a person with disabilities of groups 1 and 2, but one that contains signs of a permanent nature and accompany the above-mentioned persons to leave the territory of the country. The documents that will confirm a person's right to leave according to this criterion are those that confirm receipt of cash payments for care. In addition, an act stating that such a person really cares for one of the parents is necessary.
  • which requires constant care through the accompaniment of one of the family relatives of the first degree of consanguinity. This means that a person who has a permanent need for care can travel abroad together with his father, mother, wife, husband, son or daughter (including if they were adopted). This person must also have the appropriate documents in hand that confirm their family relationship and the need for such care.
  • permanently dependent, who have 3 or more children under 18 years of age. At the same time, children can be from different marriages. Only the fact that children are dependent on such a person should be established by law. Documents that are necessary to confirm this fact (certificate of a father with many children).
