Construction amnesty – 2018

In Ukraine since 2018 the so-called "amnesty of construction" began to operate. This is an affordable and quick way to legalize unauthorized construction if the construction work took place between August 5, 1992 and March 12, 2011, and do not violate state building regulations for the placement of the facility.

The legalization of unauthorized construction within the framework of the "amnesty of construction" will be held in accordance with the Law of Ukraine "On Amendments to the Law of Ukraine" On the Regulation of Urban Planning "regarding the commissioning of construction projects built without permission to perform construction works" dated January 13, 2015, No. 92- VIII and the order of the Ministry of Regional Development No. 79 "On Approval of the Procedure for the Acceptance and Technical Inspection of Individual (Homes) Homes, Gardens, Dacha Homes, Homes garden buildings and structures, public buildings and buildings and constructions of agricultural purpose of categories I and II of complexity, which are built without a permit for construction work. "

According to these documents, the "construction amnesty" includes:

Individual (manor) residential houses, garden, country houses, household (private) buildings and structures;

Public buildings of categories I and II of complexity;

Buildings and structures of agricultural purpose I and II categories of complexity.

In order to legitimize the unauthorized construction of a residential building up to 300 square meters. Abu of commercial building up to 100 sq.m. A citizen should collect the following package of documents:

- a statement.

- two copies of the completed declaration on the acceptance of the facility in operation.

- Confirmated in the established manner copies of the document certifying the ownership or use of the land on which the object is located. And a copy of the technical passport (with a note on the technical inspection conducted).

The procedure foresees the possibility of using technical passports drawn up prior to the entry into force of the Order, as well as reports on conducting a technical survey, drawn up from April 29, 2013 until the entry into force of the specified procedure.

To legalize a house over 300 square meters. m or another object should collect the following package of documents:

• Statement
• Two copies of a completed declaration on the acceptance of the facility in operation.
• Report on conducting a technical inspection of the facility with information on the possibility of its reliable and safe operation.
• Confirmed copies of the document certifying the title or use of the land plot on which the object is located and a copy of the technical passport.
